Shane Brennan sets CBS dramas, taps prod'n prexy

BrennanAnderson Shane Brennan is firing up his development for the 2012-13 season with two drama projects set up at CBS, one of which is a private eye vehicle based on the "King and Maxwell" novel series by David Baldacci.Brennan, the exec producer of CBS' sturdy "NCIS: Los Angeles" and "NCIS" franchises, has also recruited former CBS TV Studios current programming exec Grant Anderson to serve as prexy of his Shane Brennan Prods., which inked a megabucks overall deal with CBS TV Studios in April (Daily Variety, April 21).The "King and Maxwell" project has been developed with Baldacci and his producing partner,Karen Spiegel. Brennan will pen the pilot that revolves around two former Secret Service agents-turned-private investigators. Brennan said he's a fan of Baldacci's many books and believes that the male and femme sleuths of "King and Maxwell" are "absolutely television characters -- they're the sort of characters I would develop myself."The concept of the series is very contemporary as it involves "insiders who get involved in cases where discretion is needed," he said. "It's very much a series of our time when we have so much frustration and suspicion of government and intelligence agencies."The other project Brennan is shepherding is a medical procedural from scribe Jordan Hawley ("Smallville"), who will write the pilot script. Concept for "Cure" revolves around a team of doctors who travel the country taking on unusual medical cases in the hope of finding a cure for a reclusive billionaire's terminally ill child.Brennan said he sparked immediately to Hawley's pitch."It just screams out to be made as a TV show," he said. "I've never envisioned a TV series so clearly as when Jordan walked in and pitched us his idea."Brennan made the decision in the spring to focus on development for the 2012-13 season. For the coming season, he has turned over the showrunner reins on "NCIS" to exec producer Gary Glasberg. He remains at the helm of "NCIS: LA."Anderson moved over to Brennan's shop about six weeks ago to help hone the development projects. He's spent the past six years at CBS TV Studios, most recently serving as veep of current programming. He's worked closely with Brennan on both "NCIS" shows as well as the "CSI" skeins and "Criminal Minds." Before working as an exec, he was a producer on NBC's "Third Watch." "Grant is particularly good with giving incisive notes because of his production experience," Brennan said. "It's rare to find someone with that kind of detailed understanding of a production's needs."Brennan and Baldacci are repped by Paradigm. Brennan's also repped by attorney Kevin Kelly of Gendler and Kelly. Contact Cynthia Littleton at cynthia.littleton@variety.com

Relativity Hit With Second 'Catfish' Suit as Legal Fight Gets To Be More Bizarre (Exclusive)

Rogue Relativity Media, presently protecting an amazing copyright suit against its 2010 documentary Catfish, continues to be prosecuted again within the film. And that we've found that the Ryan Kavanaugh company might be ready to launch a counterattack from the lawyer representing among the litigants. First, some background about this remarkable situation. In The month of january, Spin Move Records prosecuted the manufacturers of Catfish since the questionable film allegedly used a copyrighted song fromsinger-songwriterAmy Kuneywithout permission. The film purports to become a documentary a good incredible hoax, however, many have pointed to circumstantial evidence the filmmakers had staged a few of the moments and were thus playing a hoax about the audience. Within the legal context, the main difference from a real documentary along with a faux documentary could mean the main difference between "fair use" from the song and copyright violation. The filmmakers maintain that Catfish is 100% authentic, opening questions regarding the character of creative license within the documentary filmmaking genre in particular. For additional particulars concerning the accusations, take a look at our prior article. Now, according toCatfishdistributor Relativity, the filmhas an unrecouped balance in excess of $8.5 million and won't likely ever become lucrative. Further, the organization highlights that since the copyright about the song was registered late, Spin Move are only able to seek actual damages -- the need for an acceptable certification fee for that song -- so it thinks would add up to a maximum of $35,000. So do not know copyright suit being went after for this type of modest reward? According toRelativity's lawyer,Shaun Sanders, it's because Spin Move's lawyer Neville Manley includes a legal technique to extract greater than actual damages within this dispute. One might say it's an alleged two-part plan. First, in federal court papers, Sanders highlights a provision of federal copyright law that enables effective parties to recuperate attorney costs. Quite simply, even when Spin Move's potential pay-out is modest, Manley could possibly win compensation from Relativity for his billable hrs. Second, a suit continues to be filed now within the United kingdom against Catfish through the copyright holder of the song which made an appearance within the film. Based on Sanders, Manley arrived at to other songwriters and allegedly interfered using the producer's capability to close a certification deal. He states that Manley is attempting to make the legal defense so troublesome and costly that Relativity will have to pay a higher settlement add up to place it to mattress. Manley calls the allegation "absolutely false," the United kingdom complaintant approached him, which any disputes within the United kingdom on the movie that allegedly removed no privileges before its release is going to be potentially harmful for Relativity because there's no "fair use" doctrine there. To the problem of attorney costs. Inside a highly improbable move, Sanders is demanding use of Spin Move's attorney engagement contract(s) with Manley, such as the fee arrangement. "Because the fee application is clearly the tail wagging your dog, discovery of Litigants fee arrangement is extremely relevant, because the potential fee application may be the finest quantity of value in dispute within this situation," writesSandersin an ex-parte application towards the court on Tuesday. Not remarkably, Manley is intensely fighting the demand. He takes exception towards the untimely and procedurally defective way it had been made, and states it's premature to create such documents before any motion for costs has been manufactured. In the opposition, Manley states similarly info it "remains safe and secure through the attorney-client privilege and it is entirely irrelevant for this copyright action." Manley informs THR that he's "befuddled through the motion." Approached for explanation, Sanders states the info has been asked for prior to challenging any award of legal costs to Manley. "Should you challenge a fee award with evidence, you best have it in discovery," he states. Meanwhile, Relativity might be about the verge of filing its suit against Manley's firm. Sanders points our focus on the firm's reposting of THR's original suit story on its website. The content there's embellished with a copy of theCatfish poster image, which Sanders states signifies an violation of copyrighted material. Manley responds this allegation is simply too absurd to merit an answer, asking, "Haven't they heard about fair use like a defense?" TW Cable tightens grip with Insight buy

BrittTime Warner Cable is tightening its grip on key Midwestern markets with its deal to acquire cable operator Insight Communications for $3 billion in cash. The deal unveiled Monday will bring Time Warner Cable's total subscriber count to about 14.75 million -- which keeps it the nation's No. 3 subscription TV provider behind Comcast (22.5 million) and DirecTV (19.4 million).Insight serves about 750,000 sub-scribers in Indiana, Ohio and Kentucky, markets where Time Warner Cable already had a strong footprint. Of those subs, about 537,000 are the high-speed data subscribers most coveted by cable operators.Insight has been owned since it went private in 2005 by private equity firms the Carlyle Group, Crestview Partners and MidOcean Partners as well as some of Insight's top managers."We believe in our business and its long-term prospects, and have long thought that Insight's well-run, technologically advanced systems would fit well with our Midwest operations," said TW Cable topper Glenn Britt in announcing the acquisition.TW Cable said it expected to squeeze $100 million in savings from programming expenses and other streamlined areas within two years of the deal's closing.Research firm SNL Kagan noted that the pricetag was on the high end of recent cable acquisitions, but that the premium made sense for TW Cable because of the location and the fact that Insight's properties have been recently upgraded.Wall Street had a lukewarm reaction to the deal, which was dwarfed by the concurrent announcement of Google's $12.5 billion acquisition of Motorola. Time Warner Cable shares were down 49 at the close of trading to $65.02.Despite the all-cash transaction, TW Cable execs emphasized that the company would continue to pay a quarterly dividend to shareholders and continue with its $4 billion stock buyback program initiated last year. Jane Lynch on Hosting the Emmys: We're Leaving Sue Sylvester's Tracksuit at Home

Jane Lynch Jane Lynch will be the host of the 63rd Annual Emmy Awards - not her Glee alter ego Sue Sylvester.Glee's Jane Lynch on her next role: Emmy host"I think a little bit of Sue Sylvester goes a long way," Lynch said at the Television Critics Association press fall TV preview Friday. "There are some Sue ideas floating around out there, but I think we'll leave her track suit on the Paramount lot."As for what we will see, Lynch promises that she'll do almost any bit that works. Recalling Rob Lowe's famously disastrous number with Snow White at the Oscars in 1989, Lynch said, "My goal is that no one will cringe or that at least very few people will cringe."Reality guru Mark Burnett will executive-produce the show, and he promises more short bits that will keep the three-hour telecast moving along. "If [awards shows] are just about giving out awards, it can slow down. ...It's about having fun."Check out photos of Jane LynchApparently, that will also extend the in memoriam montage. "It doesn't need to be a bummer," he said. "It can be a celebration... a raising up of the work that was left behind. We want to raise up, not bring down."Burnett, who has produced several of MTV's awards shows in the past few years, also promises to bring a little bit of irreverence to the "edgier" Fox network in terms of poking fun at Hollywood. But don't expect it to go as far as Ricky Gervais' controversial Golden Globes performance."How far can you take the joke with your mother before she comes back at you?" asked John Shaffner, the chairman of Academy of Television Arts & Sciences. "It's about how much love and affection you bring to the poke."Adds Lynch: "My sensibility ... [doesn't] have that kind of snarkiness that [Gervais] has. Though I am a huge fan of his and I laughed quite a few times."The 63rd Annual Emmy Awards air Sunday, Sept. 18 at 8/7c on Fox.
